Attorneys want McHenry County State's Attorney candidate's suit against letter writer dismissedAttorneys for an 81-year-old Marengo woman sued by the Democratic candidate for McHenry County State’s Attorney over a letter to the editor she wrote are seeking to get the lawsuit tossed out of court. Motions filed last week by defense attorneys Robert Hanlon and Philip Prossnitz are asking McHenry County Judge Thomas A. Meyer to rule that the lawsuit filed by candidate James Harrison against letter writer Sandi Tenglin is a strategic lawsuit against public participation, known as SLAPP for short. Under Illinois law, Harrison must now prove that the lawsuit has merit and is not intended to stifle the valid exercise of First Amendment rights. Harrison, a Johnsburg lawyer with a Woodstock practice, alleges in his lawsuit that Tenglin’s May 13 letter in the Northwest Herald falsely implied that he engaged in unethical and illegal conduct as a result of doing work for former State’s Attorney Gary Pack. The lawsuit alleges that Tenglin’s letter insinuates a quid pro quo arrangement and implies that he bribed a public official. But in his motion to dismiss, Hanlon argues that Harrison’s paid work for Pack, and his donations to Pack’s campaign, are public record. He also called it a “leap of faith” for Harrison to say that the letter accuses him of bribery.
