Standing before a Calhoun County circuit judge last month, attorney David Johnston asked that evidence from a polygraph test be excluded from a 2003 cold-case murder trial. “We know that is not admissible evidence,” Assistant District Attorney Lynn Hammond responded. Polygraph tests can be submitted as evidence in Alabama courts but could be grounds for appeal after a trial ended, Circuit Judge Debra Jones said by phone Friday. “They are really used more so as an investigative tool,” she said. Polygraphs, a decades-old technology that monitors a subject’s breathing, heart rate and sweat in an attempt to detect deception, according to law, are not reliable information because they do not stand up to the scientific method.
