State drops appeals, agrees to pay $517,000 to motorcyclist kicked by OSP captainThe state of Oregon has agreed to pay more than $500,000 to bring an end to a federal civil rights case in which a state police captain roughed up a motorcyclist during a traffic stop west of Eugene in 2012. The 9th U.S. Circuit Court of Appeals on Friday granted the state’s motion to dismiss a pair of appeals it had filed in plaintiff Justin Wilkens’ case, which drew widespread attention thanks to a video recording of the Eugene man’s roadside encounter with Oregon State Police Capt. Rob Edwards. The state will pay Wilkens a total of $517,009. The sum will cover both the $181,170 in total damages awarded to him by a federal jury in January, as well as more than $335,000 in attorney fees and court costs ordered by the judge who presided over his civil trial in U.S. District Court in Eugene. State Department of Justice spokeswoman Kristina Edmunson referred additional questions to state police. Lt. Bill Fugate, a spokesman for the state police, said he did not know enough about the court case to offer any immediate comment on why the appeals had been dropped.
