An Iraq War veteran has filed a federal lawsuit against OSS Health, alleging that in 2015 she was denied access to aquatic therapy and discriminated against because she’s HIV-positive. The plaintiff, 40, of York County, is identified by a pseudonym: Bonnie Jones. In the lawsuit, she is asking for a declaratory judgment stating that those practices constitute discrimination under the Americans with Disabilities Act. “The Americans with Disabilities Act is not a new law,” said Ronda Goldfein, the executive director of the AIDS Law Project of Pennsylvania, which filed the complaint on behalf of Jones. “It’s pretty clear the law of the land is you can’t treat people with HIV differently, but we still see it.” Drayer Physical Therapy Institute, which is involved in the program, and Timothy Burch, a physical therapist, are also named as defendants. The lawsuit was filed on Thursday in the U.S. District Court for the Middle District of Pennsylvania.
