The U.S. Supreme Court announced Monday that it would not hear Gov. Eddie Calvo’s appeal of a lower court’s order that Guam pay $1.7 million in legal fees to the attorneys representing Guam residents who successfully sued to require the government of Guam to pay income tax refunds in a timely manner. The high court issued a 14-page order list indicating that the case, Guam, et al. v. Paeste, Rea O., et al, was among dozens of petitions for a writ of certiorari, or review, that were denied. Two such petitions were granted, according to the list. The denial means the lower court rulings stand. In the Paeste case which was filed in April 2011, the government of Guam was ordered by the U.S. District Court of Guam in 2013 to pay income tax refunds within six months of the tax deadline. It was also ordered to pay the plaintiffs’ legal fees. The government of Guam appealed the case to the Ninth Circuit, and in August 2015 the court upheld the District Court’s ruling in a strongly worded decision.
