The administration’s decision last year to deny a marriage application to a same-sex couple, contrary to the attorney general’s advice, will cost taxpayers tens of thousands of dollars in legal fees. The federal court on Wednesday ordered the government of Guam to pay $85,417.65 in legal expenses for Kathleen Aguero and Loretta Pangelinan, a same-sex couple who last April sued Gov. Eddie Calvo and registrar Carolyn Garrido after they were denied a marriage application by the Department of Public Health and Social Services. Guam law at the time specifically defined marriage as a union between couples of the opposite sex. According to court documents filed last year, attorney Mitch Thompson, who represents Pangelinan and Aguero, stated the case didn’t have to go to court, but efforts to resolve the issue through the governor’s legal team had failed.
