Superior Court throws out some charges against former PSU administratorsThe state Superior Court on Friday dismissed several criminal counts against three former Penn State administrators charged as part of the Jerry Sandusky sex assault case, finding that they were not properly represented by the university’s general counsel during their own grand jury testimony. Three opinions, all written by Judge Mary Jane Bowes, were issued, calling into question the actions of Cynthia Baldwin, a former state Supreme Court justice and general counsel at Penn State. The Superior Court quashed counts of perjury, obstruction of justice and conspiracy for former university president Graham Spanier and former vice president Gary Schultz. It also quashed charges of obstruction and conspiracy against former athletic director Timothy Curley. The court found Ms. Baldwin breached attorney-client privilege when she went before the investigating grand jury in 2012. Ms. Baldwin had appeared with each of the men when they testified on their own behalf at the grand jury, and they believed that she was there representing their interests.
