The Laramie City Council is scheduled to repeal a city-imposed mandatory sentencing provision for some drunk drivers, as well as a possible rate increase for solid waste disposal services, during its regular meeting today. Under its current municipal code, anyone caught driving with a blood-alcohol content above 0.15 — just less than twice the legal limit of 0.08 — would face a mandatory jail sentence. First-time offenders would spend a minimum of seven days in the detention center, while second and subsequent offenses call for a 30-day minimum. However, the Wyoming Supreme Court decided in favor of two DUI offenders’ appeals of their mandatory sentences, ruling Laramie’s ordinance conflicted with state statutes’ limitations on municipal authority in DUI sentences. Lt. Gwen Smith of the Laramie Police Department said local law enforcement officials supported Laramie’s ordinance as part of being proactive in dealing with those who over-consume alcohol and drive.
