Two lawsuits have been filed against Dickenson County Commonwealth’s Attorney Chadwick Seth Baker by a former administrative assistant who was fired a year ago.
The lawsuits were filed on behalf of Sheila Viers, a nearly 30-year employee who claims she suffered emotional harm and that Baker violated Virginia code when he hired her replacement because he didn’t properly advertise the open position.
The first lawsuit, filed on Dec. 30, states that Baker fired Viers Jan. 4, the same day he posted the position on the Virginia Compensation Board website. The suit goes on to say that Baker hired his former secretary, who was the sole applicant, on Jan. 6, although records show he received her resume on the night of Jan. 3 – hours before Viers was fired.
The lawsuit asks the court to appoint an acting commonwealth’s attorney to prosecute the case and impose a civil penalty of $2,000 on Baker for violating Virginia Code Section 15.2-1604 C, which requires that such jobs be advertised in a newspaper or a state or local government job service.
