A former senior state prosecutor is fighting Attorney General Kathleen Kane's attempt to delay action on a federal lawsuit he filed against her over his termination. Kane is seeking a stay to put James P. Barker's suit on hold while she battles separate criminal charges that she leaked grand jury information. She cited a possible probe into Barker's firing as a reason for delay as well. Barker filed a reply in U.S. Middle District Court this week, arguing there is no legal reason to defer his suit. He rejected Kane's claim that she might have to invoke her constitutional right against self-incrimination if she has to simultaneously defend herself in the civil and criminal cases.
