Embattled State Sen. Virgil Smith agreed to a plea deal that would require him to serve 10 months in the Wayne County Jail with no early release and resign from his job as a legislator for an incident where he was accused of assaulting his ex-wife and shooting her Mercedes-Benz. Smith, 36, would also serve five years probation, cannot hold elected or appointed office during his probation, must comply with alcohol and drug treatment, must submit to a mental health evaluation, surrender the gun he used in the incident or say where it is and pay restitution to the victim in the case. As part of the deal, he pleaded guilty to malicious destruction of personal property-$20,000 00 or more, a felony punishable by up to 10 years in prison. Smith, a Detroit Democrat, was charged with three felonies and a misdemeanor in connection with the May incident. As part of the plea, counts 2-4, which include felonious assault, possession of a firearm during the commission of a felony and a misdemeanor count of domestic violence, will be dismissed.
