CHEYENNE – The Wyoming Senate Judiciary Committee on Monday recommended approval of a bill that would clarify state law on marijuana edibles. Senate File 96 would make it illegal to possess any baked goods, candies or similar substances containing marijuana or its active ingredient, THC. In the past, some district court judges have been reluctant to adjudicate cases involving marijuana edibles, since it’s difficult to determine how much THC they contain. SF 96 was amended so that anyone caught with three or more ounces (down from one pound) of edibles would be committing a felony punishable by up to five years in prison. Lesser amounts would be a misdemeanor. Sen. Michael Von Flatern, R-Gillette, opposed both the bill and its amendment, arguing that there isn’t a reliable enough way of testing THC content in edibles, and it wasn’t right for someone to become a felon for having, say, three pounds of brownies with only a very small amount of THC content.
