A lawyer for the state Gaming Commission was charged with drunken driving after he was allegedly found passed out behind the wheel of a car that hit the front steps of the YMCA’s Lally Day Care Center on South Ten Broeck Street in Scotia on Monday afternoon.
Kent D. Vanderwal of Niskayuna was unconscious with an open alcoholic beverage next to him when police came upon his car at 1:15 p.m., police said. Police said Vander Wal, who has two prior DUI convictions in the past decade, struggled with officers at police headquarters and refused a breath test.
A 2010 report from the office of then-Inspector General Joseph Fisch concluded that Vander Wal and two other state attorneys were hired “in apparent violation of state law after their agencies customized exams to guarantee the hires. As a result of the manipulation all three scored ‘100’ on the Legal Specialties Exam and were hired immediately.”
The report found no evidence that any of the attorneys were involved in or aware of the manipulation. Vander Wal was hired by the state Lottery Division in July 2008, two years after securing an internship there when he was still in law school.
