Supreme Court: 20-year delay in DUI case violated man's right to speedy trialGRAND FORKS — It took 20 years for Jason William Gale to be found guilty of a Grand Forks DUI charge, but it only took about eight months to reverse that decision. Gale argued the judgment shouldn’t stick because the two-decade delay violated his Sixth Amendment right to a speedy trial, and the North Dakota Supreme Court agreed. The Court ruled Tuesday that Gale’s criminal judgment should be dismissed because he didn’t have a speedy trial. Gale was arrested on Columbia Road in Grand Forks on the DUI charge in 1995. Gale hired Henry Howe as his attorney and signed a “limited power of attorney,” authorizing Howe to appear in court on Gale’s behalf.
