Two nurses formerly employed by a South Abington Twp. home health care provider filed a whistleblower’s lawsuit against the company, claiming they were illegally fired last month in retaliation for reporting Medicaid billing fraud. The lawsuit filed on behalf of Deborah Botscheller of Dalton and Gina Gilgallon of Scranton seeks monetary damages from Pediatric Services of America, doing business as PSA Healthcare, which provides home health care and other services for medically fragile children and adults. The suit comes eight months after the firm’s parent company, located in Atlanta, agreed to pay $6.88 million to resolve a complaint the U.S. Department of Justice filed in Georgia. In that case, which was also initiated by employees, the government alleged PSA withheld overpayments it received from Medicaid and that it fraudulently billed for some services. The settlement, reached in August, was joined by 19 states, including Pennsylvania. As part of the deal, PSA signed a Corporate Integrity Agreement that requires it to implement procedures to detect conduct similar to that which gave rise to the settlement.
