Former Massey Energy CEO Don Blankenship on Friday paid his $250,000 criminal fine, even as his lawyers got moving on their appeal of his conviction for conspiring to violate mine safety standards at the Upper Big Branch Mine where 29 workers died in an April 2010 explosion. U.S. District Court officials posted to the court’s computer docket system a receipt for Blankenship’s fine -- along with a standard $25 court assessment -- indicating the amount was paid on Friday by someone from Spilman Thomas & Battle, the local law firm that worked on his defense. Also Friday, the 4th U.S. Circuit of Appeals opened its own docket for Blankenship’s case, a day after his defense team filed their formal notice that they are appealing his conviction. Blankenship’s lawyers have also indicated that they plan to ask the 4th Circuit to review and overturn U.S. District Judge Irene Berger’s refusal to allow Blankenship to remain free on $1 million bond pending a full hearing and decision on his conviction appeal.
