UNT student fatally shot by police had alcohol, marijuana in system
FORT WORTH - A University of North Texas student fatally shot by a campus police officer in December was drunk and had marijuana in his system, according to a toxicology report released by the Tarrant County medical examiner’s office Monday. Ryan McMillan, 21, of Fort Worth, was shot twice in the chest and once in the arm, the report shows. His blood-alcohol concentration level was 0.21 percent, according to the report. Although McMillan wasn’t driving a vehicle at the time of the incident, by comparison, the legal limit limit for driving is .08. Last month, a Tarrant County grand jury decided to take no action against Cpl. Stephen Bean, the UNT police officer who shot McMillan early Dec. 13. McMillan had been out that night celebrating his birthday. A police video showed McMillan walking toward the officer with an ax near West Oak and Fry streets near the campus in Denton. Police went there about 1 a.m. in response to criminal mischief reports. McMillan was accused of smashing at least 10 cars with the ax before Bean arrived.
