Rutledge approves wording of proposal to cap damages in medical suitsLITTLE ROCK — Attorney General Leslie Rutledge on Wednesday approved the wording of a proposed ballot item that would direct the state Legislature to set a cap on punitive damages in medical malpractice cases. The proposed constitutional amendment, if placed on the ballot and approved by voters, would require the cap to be no smaller than $250,000 and would direct the state Supreme Court to adjust the cap every two years based on inflation or deflation. The proposal, submitted by Little Rock lawyer Dan Greenberg, also would prohibit lawyers from charging excessive contingency fees, defined as more than a third of the amount recovered in a civil suit.
