A total of nine former Triumph Foods workers have joined a civil lawsuit against their former employer. All say they were injured on the job, attempted to exercise their workers’ compensation rights and were unjustly terminated. The Montee Law Firm, which is representing the injured workers, maintains the company generates $1.6 billion in annual revenues. Kevin Kelley filed the lawsuit in November 2015, claiming his dismissal was retaliatory termination after he was injured on the job earlier that year. Eight other employees — Bradley Rood and Ryan Brownly, Savannah, Missouri; Rebecca Schanke, Waterloo, Iowa; Tammy Wolfe-Enzbrenner, Atchison, Kansas; Brandy Elliott, DeKalb, Missouri; Zachary Way, David Bradley and Robert Wolfenbarger, St. Joseph; all have joined the lawsuit. A ninth individual, James Sly, Lancaster, Missouri, also suffered injuries, attempted to exercise his workers’ compensation rights and received a constructive discharge.
