Catholic school sues public district and state to force free busing
A small Catholic school in Washington County is suing its local public school district and the state Department of Public Instruction after the district refused to provide free busing for three of its students.
The conservative public interest law firm Wisconsin Institute for Law & Liberty filed the lawsuit earlier this month on behalf of St. Augustine School Inc. in Hartford.
Under state law, public school districts must provide transportation to private school students who live in their geographic area if they meet certain criteria. However, districts can refuse students if a school’s attendance area overlaps with another of the same denomination.
St. Augustine argues that the provision should not apply because it is an independent Catholic school, unaffiliated with the Archdiocese of Milwaukee.
