State Auditor Jim Zeigler Thursday ordered Gov. Robert Bentley to appear before him and testify about his use of state funds and his personal and professional relationship with a former staffer. Zeigler, citing a part of Alabama Code allowing the state auditor to get information on audited claims, ordered Bentley to appear before him on May 2 to address 11 separate areas, including the spending of BP money; his use of planes and records related to the use of state aircraft or resources with former senior political adviser Rebekah Caldwell Mason. Bentley’s office said they had no comment Thursday evening. “When you read the state constitution and the state code, you’ll find some interesting stuff,” Zeigler said in a statement. “Like the power to compel officials to appear, and to put them under oath, which is vested in my office as state auditor.” It is unclear how or whether Zeigler can compel testimony from Bentley. Despite the code section, neither the state constitution nor state law gives the auditor explicit subpoena power or methods of enforcement.
