Colorado Supreme Court strikes down Longmont's voter-approved fracking banThe Colorado Supreme Court struck down Longmont's voter-approved fracking ban Monday, ruling that the local prohibition interferes with state regulations and the state's interest in oil and gas development. "Accordingly, the court holds that Longmont's fracking ban is preempted by state law and, therefore, is invalid and unenforceable," Justice Richard Gabriel wrote in the opinion. Following the ruling, Longmont spokesman Rigo Leal confirmed the city no longer will enforce its ban on hydraulic fracturing or disposing of fracking wastes within city limits. It would take a vote of the people, however, to remove the language from the city charter. Voters added the ban to Longmont's charter in 2012 after some felt frustration when the City Council temporarily tabled oil and gas regulations that would have gone beyond the state requirements for drilling.
