Disgraced Probation Commissioner John J. O’Brien may end up keeping the tens of thousands of dollars he’s collected in retirement checks since being convicted of racketeering charges in 2014. State retirement board members voted behind closed doors last month to nix their own decision that would have forced O’Brien and one of his former lieutenants to pay back the $56,000 and $55,000 they’ve raked in respectively since their convictions. In doing so, the board — which also stripped O’Brien and Elizabeth Tavares of their pensions in whole — remanded the decision back to a hearing officer, who will prepare a new recommendation for the board to consider, stating whether
they think the two should return the funds. The move came just days after the state’s high court ordered retirement officials to pay ex-state Speaker Salvatore F.
