An Indianapolis-based group pushing for the legalization of marijuana filed a federal lawsuit Thursday against Tippecanoe County, claiming that commissioners denied permission to hold a rally on courthouse grounds. The Indiana chapter of the American Civil Liberties Union filed the suit in U.S. District Court in Hammond on behalf of Higher Society of Indiana Inc., challenging the county’s “closed forum” rule that allows county commissioners to pick and choose who gets use of courthouse grounds. David Byers, president of the three-member Tippecanoe County commissioners, said he hadn’t seen the lawsuit as of early Thursday. But he said the lawsuit comes at a time when commissioners already had been asking whether it’s time to change the policy. Byers hinted that the situation could jeopardize a number of popular community events that use courthouse grounds.
