Judge upholds lawsuit against Knox schools by families of disabled students
A federal judge has denied a request by Knox County Schools to dismiss a lawsuit filed by three families who allege students with disabilities in the school system have been placed in more segregated settings than necessary.
In September, the three families of students who attend Rocky Hill, Ball Camp and Brickey-McCloud elementary schools filed the lawsuit in U.S. District Court in Nashville alleging "long failures by (Knox County Schools) to adhere to principles of 'least restrictive environment' for children with pervasive disabilities like developmental delay, autism, intellectual disability, other health impairment or multiple disabilities," according to the lawsuit.
The families of the students, who were identified in the lawsuit by their initials, have also named the Tennessee Department of Education in the lawsuit.
In an opinion filed this week, U.S. District Judge Aleta Trauger ruled because the families are challenging systemic practices it would be pointless for the district and state to try to have the case dismissed through state administrative procedures.
