Agencies ordered to pay more than $700,000 in legal costs in disabled case
COLUMBIA — Two state agencies have been ordered to pay more than $700,000 in legal fees related to a landmark 2003 federal civil rights lawsuit brought by a disabled woman.
The 4th U.S. Circuit Court of Appeals ordered the plaintiff's fees paid in 2016. The U.S. Supreme Court earlier this month declined to hear the matter, meaning the state must now pay the fees.
State officials say because a judgement has not yet been entered in the case it is still considered open and they cannot release details of how much the state has spent on legal costs to defend against the lawsuit.
The case concerned the eligibility for services and the residential placement of a South Carolina woman, called Susan Doe in the lawsuit, who is intellectually disabled and also suffers from cerebral palsy.
