Louisiana legal requirement that abortion providers have hospital admitting privileges is unconstitutional, federal judge rulesThe portion of a 2014 Louisiana law that requires abortion clinic doctors have admitting privileges to a hospital, with obstetrical and gynecological services, within 30 miles of where the pregnancy-ending procedure is performed is unconstitutional, a Baton Rouge federal judge ruled Tuesday. U.S. District Judge John deGravelles said the requirement violates the due process rights of Louisiana women seeking abortions. The judge preliminarily blocked enforcement of the controversial requirement and scheduled a Jan. 29 status conference to consider, among other things, whether to convert the preliminary injunction to a permanent one. Anti-abortion supporters say the law is needed to protect the health of women who get abortions, in cases of complications, such as hemorrhaging or a perforated uterus.
