Proposed law aims to protect S.C. industries from new neighbors' lawsuits
People who buy property near an existing South Carolina manufacturer wouldn't be able to sue their industrial neighbor for such nuisances as noise and offensive odors under legislation proposed this week by Charleston area lawmakers.
The bill, which is designed to protect industry from expensive litigation, has drawn criticism from environmental groups.
It essentially would create a "buyer beware" situation for new property owners by giving them little recourse against a nearby manufacturer that is operating legally and with all required permits.
"You need to do your due diligence if you’re buying a home or piece of property," said state Sen. Paul Campbell, R-Goose Creek, the bill's primary sponsor. Campbell said such lawsuits "are the worst thing for growing economic development in the state."
