Virginia doctors, health insurers win round against hospitals in battle over health care regulation RICHMOND -- Physicians and health insurers have won the first round against Virginia’s hospitals in what is shaping up to be a battle dividing the state’s health care community. The fight is over Virginia’s Certificate of Public Need program, a regulatory system dating from the 1970s that was designed to control health care costs by preventing unnecessary duplication of expensive medical facilities. Health care entities must get state regulators’ approval before building new facilities. The fray has pitted two lawmakers – both Republican physicians – against each other: Del. Chris Stolle of Virginia Beach and Del. John O’Bannon of Henrico County. A House of Delegates subcommittee Wednesday evening endorsed legislation from O’Bannon that would largely dismantle the Certificate of Public Need program over the next 18 months, opening up large swaths of the health care industry to deregulated competition.
