Abraham Ayuso, a 25-year-old Costa Mesa, Calif. resident, has been charged with a crime he couldn't possibly have committed. Ayuso got into a fight on Bourbon Street on Sunday (Jan. 10) in which he punched a woman in the face and swung a knife at her, according to a New Orleans Police report. Security guards subdued Ayuso, who then spit in the victim's eye and shouted that he was HIV positive. Ayuso was booked on aggravated assault, two simple battery charges and another charge. The fourth charge is "intentional exposure to AIDS virus," as it reads in the state statute defining the crime. AIDS is not a virus. It's a condition caused by the HIV virus. HIV cannot be transmitted through saliva. Police didn't test Ayuso before charging him with transmitting a virus that doesn't exist.
