Both sides of 'dismemberment' abortion debate ask for Kansas Supreme Court reviewAttorneys on both sides of a contentious abortion case are asking the Kansas Supreme Court to hear the matter in the wake of an unprecedented split decision by the Kansas Court of Appeals last month. On Jan. 22, the Court of Appeals split 7-7 on whether the Kansas Constitution ensures the right to an abortion and, in turn, whether a ban on so-called dismemberment abortions violated that right. The even split, a first in the court’s 39-year history, resulted in affirmation of a lower court ruling that placed an injunction on the abortion ban. The case was the first time the court had met en banc, or as a whole, since the 1980s. The ruling was a temporary victory for the Center for Reproductive Rights, which represents abortion providers in the case.
