A state appeals court has dismissed a taxpayer’s challenge to fees paid to special prosecutors in the criminal case against Attorney General Ken Paxton. The order by the Dallas-based 5th Court of Appeals, delivered Friday, was the latest setback in attempts to drastically cut fees for the appointed prosecutors in the case against Paxton, who last year was charged with three felonies related to private business deals made in 2011 and 2012, when he was a member of the Texas Legislature. Paxton has pleaded not guilty to two charges of securities fraud and one charge of failure to register with the State Securities Board. The appeals court ruling dismissed a legal challenge by Jeffory Blackard, a North Texas real estate developer who has donated to Paxton’s campaigns and filed a lawsuit seeking to limit payments to $1,000 per prosecutor for pretrial work, instead of fees of up to $300 an hour.
