Trial in the class-action case against West Virginia American Water Co. and Eastman Chemical over their roles in the January 2014 water crisis will be delayed from its current starting date in mid-July, a federal judge said Friday. U.S. District Judge John T. Copenhaver Jr. told lawyers during a monthly status hearing in the case that he would need more time to review and rule on more than two dozen motions that need to be decided before the trial, which had been set for July 12 in Charleston. The judge did not immediately set a new trial date, but said he would consider that during a case status hearing set for June 10. Among other things, the trial delay also provides time for a potential mediation session in late June, if rival factions of plaintiffs’ lawyers pursuing the case before Copenhaver and separate lawsuits pending in state court can come to agreement on holding such a mediation.
